1799 Jcription, who fhall be found within the territories of his faid Highness, without regular pafsports from the English government, it being, his Highnjs's determined refolu tion, not to fuffer; even for a day, any European foreigners to remain within the territories now fubjected to his authority, unless by confent of the said Company.

ART. VIII.

Whereas the complete protection of his Highness's Jaid territories requires that various fortreffes and strong places, fituated within the territorities of his Highness, Thould be garrifoned and commanded, as well in time of peace as of war, by British troops and officiers, his Highness Maha Rajah Myfore Kiftna Rajah Oodiaver Behauder engages, that the faid English Company Be hauder hall, at all times, be at liberty to garrifon, in whatever manner they may judge proper, fuch fortreffes and frong places, within his faid Highness's territories, as it fhall appear to them advisable to take charge of.

ART. IX.

And whereas, in confequence of the fyftem of de fence which it may be expedient to adopt for the fecurity of the territorial poffeffions of his Higlinefs Maha Rajah Myfore Kiina Rajah Oodiaver Behauder, it may be ne Cellary that certain forts and frong places within his Highness's territories, Jhould be dor defroyed,

and that other forts and strong places fhould be streng thened and repaired, it is ftipulated and agreed, that the English East India Company fhall be the fole judges of the necefity of any fuch alterations in the fortreffes. And it is further agreed, that fuch expences as may be incurred on this account, fhall be borne and defrayed, in equal proportion, by the contrailing parties.

ART. X.

In cafe it fhall become neceffary for enforcing and maintaining the authority and government of his Highness in the territories now Jubjeed to his power, that the régular troops of the English East India Company Behauder fhould be employed, it is ftipulated and agreed, that upon formal application being made for the fervice of the faid troops, they shall be employed in fuch manner as to the faid Company fhall feem fit; but it is exprefsly underflood by the contracting parties. that this

Comme l'entière protection des états de fa Hauteffe Droit de exige que diverfes fortereffes et places fortes fituées fur garnison a les for le territoire de fa Hauteffe foient munies d'une garnifon terees. et commandées en tems de paix comme en tems de guerre par des troupes et officiers britanniques, fa Hauteffe Maha Rajah Myfore Kiftna Rajah Oodiaver Behander s'engage que la dite Compagnie Anglaife des Indes Orientales aura en tout tems la liberté de mettre garnifon de quelque manière qu'elle le juge à propos dans les dites fortereffes et places fortes fur le territoire de fa Hauteffe d'après qu'elle trouvera convenable de: s'en charger.

Et comme en confequence du fyfteme defenfif Forteres qu'il pourrait être convenable d'adopter pour la fureté es des poffeffions territoriales de fa Hanteffe Maha Rajah autres, a Myfore Kitna Rajah Oodiaver Behauder il pourrait être neceffaire que de certaines fortereffe et places fortes.. fur le territoire de fa Hauteffe foient démantelées ou démolies et que d'autres fortereffes et places fortes foient fortifiées et reparées, il eft ftipulé et convenu que la Comp. Anglaife des Indes Orientales fera feule juge de la neceffité de tels changemens dans les fortereffes. Et il eft convenu de plus, que les fraix qui pourraient être occafionnés de ce chef feront fupportés et payés en proportion égale par les parties contractantes.

ART. X.

ART. XI.

It being expedient, for the restoration and permanent establishment of tranquillity in the territories now Jubjected to the authority of his Highnefs Maha Rajah Myfore Kiftna Rajah Oodiaver Behauder, that suitable provifion fhould be made for certain officers of rank in the fervice of the late Tippoo Sultaun, his Highness agrees to enter into the immediate difcuffion of this point, and to fix the amount of the funds (as soon as the necessary information can be obtained) to be granted for this purpose, in a separate article to be hereafter added to this treaty..

ART. XII.

Left the garrifon of Seringapatam fhould, at any time, be fubject to inconvenience from the high price of provifions and other neceffaries, his Highnes Maha Rajah Myfore Kiftna Rajah Oodiaver Behauder agrees, that fuch quantities of provifions, and other neceffaires, as may be required for the ufe and confumption of the troops compofing the faid garrifon, fhall be allowed to enter the place, from all and every part of his dominions, free of any duty, tax, or impediment, whatever.

ART. XIII.

The contralling parties hereby agree to take into their early confideration the best means of establishing fuch a commercial intercourfe between their respective dominions, as fhall be mutually beneficial to the fubjects of both governments, and to conclude a commercial treaty, for this purpose, with as little delay as possible.

ART. XIV.

His Highnefs Maha Rajah Mysore Kiftna Rajah Oodiaver Behauder, hereby promiles to pay, at all times, the utmost attention to fuch advice as the English govern ment fhall occafionally judge it neceffary to offer to him, with a view to the economy of his finances, the bitter collection of his revenues, the administration of justice, the extenfion of commerce, the encouragement of trade. agriculture, and induftry, or any other objects connected. with the advancement of his Highness's interests, the

ART. XIII.

Les parties contractantes confentent par le prefent comtraité de prendre en leur ferieufe confidération les marco. meilleurs moyens pour établir un commerce réciproque entre leurs poffeffions refpectives tel qu'il fera mutuellement avantageux aux fujets des deux gouvernemens, et pour conclure un traité de commerce à cette fin dans un auffi court delai que poffible.

ART. XIV.

Sa Hauteffe l'invincible Maha Rajah Myfore Kiftna Finan Rajah Oodiaver promet par le prefent de prêter en tout s tems la plus grande attention aux confeils que le gouvernement Anglois jugera neceffaire dans les occafions de lui donner par rapport à l'economie de fes finances, à la meilleure perception de fes revenus, l'adminiftration de la juftice, l'extenfion du commerce, l'encouragement du negoce, de l'agriculture et de l'induftrie, ou par rapport à tels autres objets relatifs à l'avance

ART. XV.

Whereas it may hereafter appear, that fome of the diftris declared by the treaty of Myfore to belong, reSpectively, to the English Company Behauder and to his Highness are inconveniently fitucted, with a view to the proper connection of their respective lines of frontier, it is hereby ftipulated between the contraffing parties, that in all fuch cafes they will proceed to fuch an adjustment, by means of an exchange or otherwife, as fhall be best fuited to the occafion.

ART. XVI

This treaty, consisting of fixteen articles, being this day, the 8th of July, anno domini 1799, corresponding the 3d of Suffer. anno Higeree 1214, and to the 7th of the monath Haffar, of the 1721 year of the Salwant aera, Jetteld and concluded at the fort of Nuzzerbah, near Seringapatam, by his Excellency Lieutenant- General George Harris, Commander in Chief of the forces of his Britannic Majefty, and of the honourable English Eaft India Company in the Carnatic and on the coast of Malabar, the honourable Colonel Arthur Wellesley. the honourable Henry Wellesley, Lieutenant-Colonel William Kirkpatrick. and Lieutenant-Colonel Barry Close, with the Maha Rajah Mysore Kiftna Rajah Oodiaver Behauder, the aforefaid gentlemen have delivered to the faid Maha Rajah one copy of the fame in English and Perfian, fealed and figned by them, and his Highness the Maha Rajah has delivered to the gentlemen aforefaid another copy, alfo in Perfian and English, bearing his feal, and figned by Luchuma. widow of the late Kiftna Rajah, and fealed and figned by Purnea, dewan to the Maha Rajah Kiftna Rajah Oodiaver.

And the aforesaid gentlemen have engaged to procure and deliver to the faid Maha Rajah," without delay, a copy of the fame under the feal and fignature of the right honourable the Governor-General, on the receipt of which by the faid Maha Rajah, the prefent treaty fhall be deemed complete and binding, on the honoura le the English East India Company, and on the Maha Rajah Myfore Kiftna Rajah Oodiaver Behauder, and the copy of it now delivered to the faid Maha Rajah fhall be returned.
